The Prospective Marriage Visa (Subclass 300) — also known as the fiancé visa — is designed for engaged couples where one partner is an overseas national. It allows the overseas partner to travel to Australia, marry their Australian fiancé(e), and then apply for the Partner Visa (Subclass 820/801) to remain in Australia permanently.

The Subclass 300 is a temporary visa valid for 9 months from the date of grant. During this period the visa holder must enter Australia and marry their sponsor. After marriage, they must apply for the onshore Partner Visa (820) before the 300 expires. Failing to marry or apply before expiry will require departing Australia.

Key requirement: You must be outside Australia when you apply for the Subclass 300 and outside Australia when the visa is granted. The application cannot be lodged or decided while the applicant is in Australia.

  • Outside AustraliaThe applicant must be outside Australia at the time of application lodgement and at the time the visa is granted. Applications lodged from inside Australia will be refused.
  • Health RequirementsThe applicant and any family members included in the application must meet Australian health requirements, which typically involves a medical examination.
  • Character RequirementsThe applicant must provide police clearance certificates from each country where they have lived for 12 months or more in the past 10 years.
  • Intend to MarryBoth the applicant and sponsor must genuinely intend to marry within the 9-month visa period. The marriage must be legally valid in Australia.
