What is the Contributory Aged Parent Visa Subclass 864?

The Contributory Aged Parent Visa Subclass 864 is a permanent residency visa for parents of pension age whose children are Australian citizens, permanent residents, or eligible New Zealand citizens settled in Australia.

It is the contributory version of the Subclass 804 — with a significantly higher contributory fee ($5,040 + $43,600) but much faster processing of approximately 12 years compared to 30 years for the 804.

An Assurance of Support is required, and applicants who lodge the 864 while inside Australia with a valid visa (such as a Visitor Visa) may be granted a Bridging Visa A (BVA), allowing them to remain lawfully in Australia during processing.

Two-Stage Pathway: Many applicants first apply for the temporary Subclass 884 (temporary contributory aged parent visa), live in Australia for 2 years, then transition to the permanent 864. This spreads the cost and provides Medicare access earlier.

Subclass 864 Requirements

The 864 requirements are very similar to the 804 — the key difference is the contributory fee:

For the Applicant (Parent)

  • Must be of pension age (currently 67 years from 1 July 2023)
  • Must pass the balance-of-family test
  • Must meet Australian health requirements
  • Must meet character requirements
  • Must have no outstanding debt to the Australian government
  • Must have an Assurance of Support (financial guarantee)

For the Sponsor (Child)

  • Must be 18 years or older. If the child is under 18, sponsorship can come from: the child’s spouse (18+), a close relative/guardian, or a community organisation
  • Must be an Australian citizen, permanent resident, or eligible New Zealand citizen
  • Must have resided in Australia for a minimum of 2 years
  • Must meet health and character requirements
  • Must commit to providing accommodation and financial support for the first 2 years

What is the Balance-of-Family Test?

Satisfied if: (a) at least half of your children are Australian citizens, permanent residents or eligible NZ citizens living in Australia, OR (b) more of your children live in Australia than in any other single country.

What is an Assurance of Support?

An Assurance of Support is a legally binding commitment by a sponsor to provide financial support so the visa holder does not rely on government welfare. Up to three people can jointly provide this assurance. The assurer must demonstrate sufficient financial capacity to support the applicant.
