The Partner Visa Onshore (Subclass 820 and 801) is a two-stage visa pathway for the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen, when the applicant is inside Australia at the time of application.

The Subclass 820 is a temporary partner visa that lets the applicant live, work and study in Australia while the Department of Home Affairs assesses the relationship. After 2 years from the original application date, the Subclass 801 permanent partner visa is granted — providing indefinite residency, Medicare access, Centrelink eligibility and a pathway to Australian citizenship. As of 25 November 2023, both visas can be granted regardless of the applicant’s location at time of grant.

Both the applicant and the sponsor (Australian partner) must meet requirements:

Subclass 820 — Applicant Requirements
  • Inside AustraliaMust be inside Australia when the application is lodged. Must hold a valid visa at time of lodgement (e.g., student, visitor, or working holiday visa).
  • Spouse or De Facto PartnerMust be married to, or in a genuine de facto relationship with, the Australian sponsor. Marriage must be valid under Australian law. De facto relationships generally require at least 12 months cohabitation (waived if registered in an Australian state or territory).
  • Age RequirementBoth parties must be 18 or older. Parental consent is required if either party is 16 or 17. No prior visa cancellations or character concerns that would prevent grant.
  • Health & CharacterMust meet Australian health requirements (medical examination) and provide police clearances from all countries lived in for 12+ months in the past 10 years.
  • Genuine Relationship EvidenceStrong evidence of a genuine, continuing relationship across financial, social, household and commitment categories is required. The Department assesses all four aspects.
Subclass 801 — Additional Requirements
  • Hold Subclass 820Must currently hold the temporary Subclass 820 visa. The 801 is assessed automatically — no new application is needed.
  • Genuine & Continuing RelationshipThe relationship must still be genuine and ongoing. Alternatively, if the sponsor has died, the applicant must have been in a genuine relationship at the time of death.
  • Long-term Relationship ShortcutIf you have been in a registered or recognised relationship for 3+ years (or 2+ years with a child) at time of lodging the 820, the 801 may be assessed without the standard 2-year wait.
  • Updated Evidence & HealthUpdated relationship evidence and fresh health/character checks may be required if checks have expired by the time the 801 is assessed.

Check Eligibility

Sponsor Registration

The Australian partner must submit a sponsorship application via ImmiAccount. The Department verifies the sponsor’s identity, character and eligibility to sponsor a partner visa applicant. This can run concurrently with the main application.

Gather Relationship Evidence

Compile strong evidence across all four categories: financial (joint accounts, shared bills), social (photos, messages, statutory declarations), household (lease/mortgage, shared address), and commitment (travel, future plans, knowledge of each other’s background). Health & Character Checks

Complete a medical examination at a Department-approved panel physician. Obtain police clearance certificates from each country lived in for 12 months or more in the past 10 years. Allow several weeks for these to arrive.

Lodge the Subclass 820 Application

Submit the application online via ImmiAccount while you are inside Australia with a valid visa. Pay the AUD $9,365 government fee. If your current visa expires before the 820 is granted, you will receive a Bridging Visa A (BVA) automatically, allowing you to remain lawfully in Australia.

Subclass 801 Permanent Assessment

After 2 years from your original lodgement date, the Department will assess your application for the permanent Subclass 801. There is no new application — just provide updated relationship evidence when requested. Once granted, you have full permanent residency rights.
