What is the Aged Parent Visa Subclass 804?

The Aged Parent Visa Subclass 804 is a permanent residency visa for parents of pension age whose children are Australian citizens, permanent residents, or eligible New Zealand citizens settled in Australia.

It is the non-contributory aged parent visa — with lower fees than the Subclass 864 — but like the 103, it operates on a cap and queue system with very lengthy processing times. A key advantage over the Subclass 103 is that applicants who lodge the 804 while in Australia are granted a Bridging Visa, allowing them to remain in Australia while their application is processed.

An Assurance of Support is required for the 804 — a financial guarantee from a sponsor that the applicant will not depend on government welfare. This distinguishes it from the Subclass 103.

Processing time warning: As at 30 September 2023, the 804 queue was up to December 2012 — approximately 30 years wait. For faster processing, consider the Contributory Aged Parent Visa Subclass 864, which costs more but processes significantly faster.

The 804 has specific requirements for the applicant (aged parent) and the sponsor (child):

For the Applicant (Parent)

  • Must be of pension age (currently 67 years from 1 July 2023)
  • Must pass the balance-of-family test
  • Must meet Australian health requirements
  • Must meet character requirements
  • Must have no outstanding debt to the Australian government
  • Must have an Assurance of Support (financial guarantee)

For the Sponsor (Child)

  • Must be 18 years or older. If the child is under 18, sponsorship can come from: the child’s spouse (18+), a close relative/guardian, or a community organisation
  • Must be an Australian citizen, permanent resident, or eligible New Zealand citizen
  • Must have resided in Australia for a minimum of 2 years
  • Must meet health and character requirements
  • Must commit to providing accommodation and financial support for the first 2 years

What is the Balance-of-Family Test?

Satisfied if: (a) at least half of your children are Australian citizens, permanent residents or eligible NZ citizens living in Australia, OR (b) more of your children live in Australia than in any other single country.

What is an Assurance of Support?

An Assurance of Support is a legally binding commitment by a sponsor to provide financial support so the visa holder does not rely on government welfare. Up to three people can jointly provide this assurance. The assurer must demonstrate sufficient financial capacity to support the applicant.
