Can I Apply for a 189 Visa While My 491 Is Still in Process?

This is a question we get asked quite often—and the answer is yes, you can apply for a subclass 189 Skilled Independent visa while your 491 Skilled Work Regional (Provisional) visa application is still processing, provided you meet the eligibility criteria at the time of lodgement.

Here’s What You Need to Know:-

If you’re currently in Australia, you must hold either:-

  • A substantive visa (like a 485 graduate visa, student visa, or visitor visa), or
  • A bridging visa A (BVA), bridging visa B (BVB), or bridging visa C (BVC)

If you meet this requirement, you can go ahead and lodge your 189 visa application without having to wait for the outcome of your 491.

Timing Matters

However, if your 491 or 494 visa has already been granted—or if it was the last substantive visa you held—then a different rule applies.

In this case, you must wait at least three years after the grant of the 491 or 494 visa before you’re eligible to apply for a 189 visa from within Australia.

That’s why timing can be crucial. If your 491 is still under processing and you’re currently on a valid substantive visa or bridging visa (A, B, or C), it might be an ideal opportunity to apply for the 189 and avoid the three-year wait entirely.
